Welcome to Sensible Funerals. These Terms and Conditions govern the funeral arrangements, mortuary services, transfers, and financial agreements provided by Sensible Funerals (ABN: 76 088 480 031). By signing our Instructions to Carry Out Funeral Service or engaging our services, you (the “Customer” or “Authorised Representative”) agree to be bound by these terms.

1. Authority and Instructions

  • Authorisation: The Customer confirms they are the Executor, Nearest Surviving Relative, or an authorised person acting with the full approval and consent of the deceased’s representatives.

  • Scope of Service: You authorise Sensible Funerals to take all necessary actions, contact third parties, and perform mortuary, sanitary, and preservation procedures required to conduct the funeral service in accordance with your wishes.

2. Bariatric Handling and Transfer Policy (Work Health & Safety)

To ensure the safety of our personnel and comply with South Australian Work Health and Safety (WHS) regulations, strict weight-based handling and equipment limits apply:

  • Maximum Weight Capacity (150kg): The maximum weight of a deceased person that Sensible Funerals can safely accommodate is 150kg. Due to strict load ratings of specialized coffin equipment, we cannot handle cases exceeding this limit.

  • Exceeding Maximum Capacity: If a deceased person in our care is found to exceed 150kg, the family will be notified immediately. We will formally advise that we cannot proceed with the funeral and will direct the family to a high-capacity specialist provider. If an alternative funeral home is not nominated within 24 hours of notification, a daily mortuary storage fee of $45 will apply, payable upon collection.

  • Bariatric Preparation Fee: For deceased persons weighing 120kg and above, a mandatory $349 Bariatric Preparation Fee applies to cover the additional staff required to ensure a dignified and safe transfer into a coffin.

  • Discretionary Margin: The application of a “+/- a few kilos” margin regarding the 120kg and 150kg thresholds rests solely at the discretion of management (Madeline or Mike).

Transfer Fee Schedule

Logistical transfer fees are tiered by weight due to the mandatory scheduling of multiple staff members (up to 2 to 4 staff members for transfers between 100kg–120kg under WHS guidelines):

  • Under 90kg: Standard Rate (per current transfer policies).

  • 90kg to 119kg: $495 flat rate (regardless of location).

  • Exceeding 120kg: $595 flat rate (regardless of location).

  • Complex Transfer Clause: For transfers exceeding 120kg, if the location or physical position demands additional personnel or specialized equipment due to Occupational Health and Safety (OHS) concerns, the price will be adjusted to cover these additional operational costs.

3. Scheduling, Bookings, and Overtime

  • Fixed Times: Booking times for viewings and services are strictly fixed out of consideration for other families.

  • Overtime Fees: Early access or overrunning the booked time slot will incur an overtime charge of $250 per half-hour (or any part thereof). This is in addition to any separate overtime fees charged by external venues.

4. Financial Responsibility and Payment Terms

  • Personal Liability: The individual signing the service instructions accepts personal responsibility for the entire cost of the funeral and associated services as outlined in the written estimate of costs.

  • Postponement/Cancellation: Failure to meet agreed-upon payment terms prior to the service may result in the funeral service being postponed or cancelled by the Funeral Director.

5. Late Payments, Fees, and Debt Collection

  • Late Payment Fee: Any account not paid by the designated due date will automatically incur a fixed late payment fee of $350.00 (inc. GST).

  • Debt Administration Costs: Interest and administration costs will be applied to outstanding balances at a rate of 1.5% per month until the account is paid in full.

  • Third-Party Recovery and Debt Collection: If any invoice remains unpaid for more than fourteen (14) days after its due date and is referred to a debt collection agency, solicitor, or other third party for recovery, the customer agrees to pay all reasonable costs incurred in recovering the outstanding debt. These costs may include, but are not limited to, debt collection agency fees, legal costs, court filing fees, and any other expenses associated with the recovery of the debt, to the extent permitted by applicable law.
